Question: Do commercial sales in Montgomery County require the REA form?

Answer: No. The Government Regulations, Easements and Assessments Disclosure and Addendum (REA) form (GCAAR Form 900) is designed for residential sales in Montgomery County, Maryland only and is an effort at providing a compilation of  required disclosures and representations required by residential sellers under Maryland State and Montgomery County law except the Seller Disclosure Disclaimer, which is s separate form (GCAAR Form 912). Most of the disclosures and requirements contained in the form apply to improved residential real property only, and thus the form is not required for commercial sales. That being said, the form also contains some disclosures and requirements for sales of all real property and thus, if the commercial seller does not use the REA form, he or she must make sure that all disclosures that are required under Maryland and Montgomery County law are being provided.
